CFR §396.3(a)(1) establishes that all parts and accessories must be in safe and proper operating condition at all times, including steering systems and any additional parts and accessories that might affect steering systems. Under CFR §396.11, every motor carrier must require drivers to report and every driver must prepare a report in writing at the completion of each day’s work on each vehicle operated. Types of Steering Failure Accident Injuries

Steering failure often leads to truck drivers losing control of their vehicles. The ways that trucks may strike other vehicles can vary depending on how a truck reacts or if it rolls over.

People who are involved in these accidents may sustain any one of a number of injuries, which may include, but are not limited to:

  • Paralysis
  • Fractures
  • Muscle strains
  • Sprains
  • Internal organ injuries
  • Neck injuries
  • Traumatic brain injuries (TBIs)
  • Spinal cord injuries
  • Lacerations

When an individual is killed in a truck accident caused by steering failure, the family could be able to recover damages through a wrongful death lawsuit.

Causes of Steering Failure

CFR § 393.209(a) requires a steering wheel to be secured and must not have any spokes cracked through or missing. The steering wheel lash cannot exceed the following parameters:

……..table needs to be inserted here…….

Under CFR § 393.209(d), universal joints and ball-and-socket joints cannot be worn, faulty, or repaired by welding. The steering gear box must not have loose or missing mounting bolts or cracks in the gear box or mounting brackets.

The pitman arm on the steering gear output shaft cannot be loose, and steering wheels must turn freely through the limit of travel in both directions. Universal joints and ball-and-socket joints wear over time and it is not surprising when a tractor-trailer with significant miles in which a driver claims steering failure also has a ball joint with a corroded surface.
